Kerala High Court Mandates Two-Week Limit for Bail Petition Decisions

The Kerala High Court has introduced strict timelines for the resolution of bail petitions, both regular and anticipatory, filed by individuals accused in criminal cases. This directive aims to expedite judicial proceedings and ensure timely justice.

According to an official notice disseminated on September 10, the Chief Justice of the Kerala High Court has decreed a maximum period of two weeks for the disposal of regular bail applications. Additionally, any time granted for legal counsel to gather necessary instructions in these regular bail matters is restricted to no more than seven working days.

For anticipatory bail applications, the High Court has set a slightly longer timeframe, mandating that such petitions must be resolved within a maximum of six weeks. This adjustment is part of a larger judicial effort to streamline bail hearings and reduce delays.

This initiative by the Kerala High Court aligns with a directive from the Supreme Court issued on May 11. The Supreme Court emphasized the need for High Courts across the country to implement measures that would accelerate the hearing process for bail applications.

The Supreme Court’s directive underscores the importance of setting definite deadlines and minimizing unnecessary adjournments in order to facilitate a more efficient judicial process. The notice from the Kerala High Court is a direct response to this call for reform, aiming to enhance the efficiency of the judicial system in handling bail matters.
