Karnataka High Court Dismisses Allegations Against Former Pearson Legal Counsel
The Karnataka High Court has dismissed criminal charges against Prashant Kumar Joshi, the former in-house legal counsel for Pearson Education and Dorling Kindersley (India) Pvt Ltd. This decision was rendered on September 11 by Justice HP Sandesh, who found that the proceedings constituted an abuse of the legal process.
Background of the Legal Proceedings
The case originated from a complaint regarding alleged violations of the Legal Metrology Act by Pearson Education. The High Court concluded that Joshi was not a designated official under Section 49 of the Legal Metrology Act, which is crucial in determining responsibility for corporate conduct in such cases. Therefore, charging him without implicating the company itself was deemed inappropriate.
Details of the Legal Metrology Violations
Issues arose when an Engineering Drawing textbook published by Pearson Education was found lacking vital labeling information, including the manufacturer’s name and address, maximum retail price, net contents, and consumer care contact details. These omissions were considered violations under both the Legal Metrology Act, 2009, and the Legal Metrology (Packaged Commodities) Rules, 2011.
Court’s Interpretation and Ruling
Justice HP Sandesh emphasized that Joshi’s role as General Manager (Legal) did not imply he was in charge of the company’s affairs. The Court referred to established legal principles of corporate liability, drawing parallels from the Negotiable Instruments Act, 1938, and relevant Supreme Court judgments. It found that prosecuting Joshi without naming the company as a party was unjust and amounted to a miscarriage of justice.
