A court in Gurugram has issued a 14-day judicial custody order for Kalyan Bainsla, accused in a hit-and-run incident involving a female motorcyclist. Along with Bainsla, who allegedly drove the vehicle, co-accused Lavneesh has also been remanded to jail. This decision was made by Judicial Magistrate Ist Class (JMIC) Nidhi Beniwal after their police custody concluded.
The two individuals were initially detained by Gurugram Police on Wednesday, following their arrest in Rajasthan on the preceding Tuesday. They are implicated in a criminal case filed at Sector 55/56 Police Station, citing violations of Sections 109 (attempt to murder), 281 (rash driving), and 125 (act endangering life or personal safety of others) under the Bharatiya Nyaya Sanhita (BNS).
Further charges under Sections 78 (stalking) and 79 (word, gesture or act intended to insult the modesty of a woman) of the BNS have also been levied against them. These charges were brought about after victim Shivani Chauhan, known on social media as Sia, uploaded a video showing a vehicle allegedly driven by Bainsla speeding towards her on Golf Course Road and colliding with her motorcycle.
The incident was captured by a camera mounted on Chauhan’s bike, showing her fall upon impact. She has accused Bainsla, also called Kalyan Singh in court documents, of harassment prior to the incident and fleeing the scene post-collision. The viral spread of the video on social media prompted the police to register a suo motu case, which initially did not include the attempt to murder charge. Later, Section 109 of the BNS was appended to the case.
This case has attracted national attention, fueling public outrage and demands for stringent action against the accused driver.
