Delhi High Court Dismisses Somnath Bharti’s Challenge to Satish Upadhyay’s Election

The Delhi High Court has dismissed a petition by Aam Aadmi Party (AAP) leader Somnath Bharti, contesting the election of Bharatiya Janata Party (BJP) MLA Satish Upadhyay from the Malviya Nagar constituency during the 2025 Delhi Assembly elections. Justice Jasmeet Singh’s ruling on Saturday effectively upheld Upadhyay’s victory.

Legal Challenge to Election Outcome

Somnath Bharti, a three-time MLA who had previously maintained an uninterrupted tenure since 2013, was defeated by BJP’s Satish Upadhyay by a margin of approximately 2,100 votes. Bharti subsequently filed an election petition, alleging that Upadhyay engaged in corrupt practices as defined under the Representation of the People Act, 1951.

In his legal challenge, Bharti accused Upadhyay of failing to disclose a pending criminal complaint or First Information Report (FIR), a disclosure he argued was mandatory under election law. Bharti contended that this omission materially affected the election’s outcome, thereby invalidating Upadhyay’s candidacy.

Defense of Allegations

Representing himself alongside advocate Anand Prakash Gautam, Bharti faced a robust defense from Upadhyay’s legal team. Senior Advocates Rajiv Nayar, Jayant Mehta, and Gautam Narayan, supported by advocates Saurabh Seth, Sumer Dev Seth, Neelampreet Kaur, Abhiroop Rathore, and Kabir Dev, argued that the allegations presented by Bharti were unfounded.

Justice Jasmeet Singh, after considering the arguments, declared Bharti’s petition dismissed, thereby affirming the legitimacy of Upadhyay’s election to the Delhi Assembly.
