Supreme Court Petition Challenges Speaker’s Recognition of Shiv Sena Merger
A petition has been filed in the Supreme Court of India contesting Lok Sabha Speaker Om Birla’s decision to approve the merger of six Shiv Sena (Uddhav Balasaheb Thackeray) MPs with the faction led by Eknath Shinde. This contentious decision has sparked legal scrutiny and political debate.
On Tuesday, the matter was brought before a bench consisting of Chief Justice of India (CJI) Surya Kant, alongside Justice Joymalya Bagchi and Justice V Mohana, for urgent consideration. Senior Advocate Devadatt Kamat, representing the petitioners, emphasized the constitutional implications of the Speaker’s decision, arguing that it effectively halted parliamentary activities for the Shiv Sena (UBT). ‘This decision has significant constitutional repercussions, as it authorizes the merger of my six MPs with a rival party,’ Kamat argued.
Chief Justice Surya Kant acknowledged the urgency of the matter, agreeing to schedule a hearing. ‘We are uncertain about tomorrow, but we will list it,’ remarked CJI Kant, indicating the court’s readiness to address the issue promptly.
The controversy stems from Speaker Om Birla’s recognition of the merger on June 18, which effectively increased the Eknath Shinde-led Shiv Sena’s strength in the Lok Sabha from seven to thirteen MPs. This development was officially recorded in a circular issued by the Lok Sabha, updating the revised party positions in the lower house of Parliament.
The decision by the Speaker has raised questions about the constitutional roles and responsibilities of various political entities and has brought into focus the balance of power within the Lok Sabha.
