Supreme Court Directs High Court on Banerjee’s Travel Plea
The Supreme Court of India has instructed the Calcutta High Court to reach a decision within a week regarding Trinamool Congress (TMC) MP Abhishek Banerjee’s request to travel abroad for eye treatment. This directive was issued on Monday, following Banerjee’s appeal against an earlier High Court decision that denied him immediate permission for international travel.
High Court’s Initial Ruling
The Calcutta High Court had previously stated that Banerjee must first undergo an evaluation by a Kolkata hospital to determine whether the necessary eye treatment could be conducted domestically. Dissatisfied with this condition, Banerjee approached the Supreme Court seeking intervention.
Supreme Court’s Bench and Instructions
Chief Justice of India (CJI) Surya Kant, along with Justices Joymalya Bagchi and V Mohana, emphasized the urgency of the matter and requested the High Court to expedite its decision. The case arises amid a series of FIRs filed against Banerjee following the BJP’s victory in the West Bengal Assembly elections on May 4. These FIRs include allegations of provocative remarks made during election campaigns.
Legal Representation and Concerns
Senior Advocate Gopal Sankaranarayanan, representing Banerjee, expressed concerns about potential delays due to the High Court’s caseload. He highlighted that Banerjee has previously traveled abroad under High Court orders. On the other side, Solicitor General Tushar Mehta, representing the State of West Bengal, suggested scheduling a specific hearing date to ensure timely resolution.
Supreme Court’s Order
In light of these arguments, the Supreme Court recorded its order, urging the High Court to conclude the matter within a week. This decision underscores the judicial system’s responsiveness to individual rights and the need for timely justice.
