High Court Rejects Bail for Ex-Serviceman in Espionage Case

The Punjab and Haryana High Court has refused to grant bail to Harpal Singh, a former Army personnel, facing charges of espionage for allegedly sharing sensitive military information with Pakistani intelligence agencies. The decision was rendered by Justice Manisha Batra, who emphasized the gravity of the accusations against Singh.

Singh, apprehended on February 7, 2023, stands accused of establishing connections with Pakistani intelligence operatives via social media platforms. Utilizing his prior experience in the Indian Army, Singh allegedly gathered and transmitted classified information regarding Army movements, war strategies, and military formations. Additionally, it is claimed that he received financial compensation for these activities.

At the time of his arrest, Singh was serving with the Defence Service Corps at the Air Force Station in Bikaner. His arrest followed a tip-off to the Special Operation Cell in Amritsar, leading to charges under the Official Secrets Act and the Bharatiya Nyaya Sanhita (BNS).

Singh’s legal representative argued that his client, who served the Indian Army honorably for nearly 17 years, was wrongfully implicated. The defense contended that Singh was not detained from any restricted military zone but was instead taken into custody from a social gathering. They argued that there was insufficient evidence to prove that Singh had transmitted any confidential information.

Despite these arguments, the Court determined that the severity of the allegations, the evidence collected, and considerations of public interest justified denying bail. Justice Manisha Batra stated, “Given the seriousness of the allegations, the nature of the material collected during the investigation, and the larger public interest involved, this Court does not find it to be a fit case for extending the concession of regular bail to the petitioner at this stage.”
