Shahdara Bar Association’s Call for Action

The Shahdara Bar Association has taken a decisive stance against two judges from the Karkardooma Courts. On Thursday, the association urged its member-advocates to abstain from appearing before these judges, either in person or through video conferencing. This action stems from multiple complaints concerning the behavior of Principal Judge SS Rathi of the Family Court and Judicial Magistrate Ritika Kansal.

Allegations of Misconduct

According to the association’s executive committee, the complaints highlight several instances where the judges allegedly treated advocates with discourtesy, humiliation, and disrespect. The committee’s resolution specifically requests all lawyers to avoid any court sessions, whether physical or virtual, overseen by Judge SS Rathi and Magistrate Ritika Kansal at the Karkardooma Courts in Delhi. The resolution emphasizes the importance of maintaining the dignity of the legal profession.

Concerns Over Judicial Conduct

The bar association expressed its concerns about the lack of action taken by the principal district judge despite being informed about the judges’ conduct. Notably, the association claimed that Judge Rathi recently referred to a senior member of the bar association as a “dalaal” or broker, a term considered derogatory.

The Shahdara Bar Association stated that such behavior not only jeopardizes the independence of the legal profession but also erodes public trust in the justice system. They highlighted the foundational principle of mutual respect, dignity, and cooperation that should govern the relationship between the Bench and the Bar.

Call for Mutual Respect

In their statement, the association reiterated the duty of advocates to uphold the highest standards of conduct and courtroom decorum. Simultaneously, it called on judicial officers to treat legal professionals with courtesy, patience, and fairness, thus upholding the dignity of the institution. The association’s resolution is a call to action for maintaining the integrity and respectability of the legal fraternity.
