In a significant legal development, the Goa government has petitioned the Supreme Court of India, seeking to enhance the penalty against former Tehelka editor Tarun Tejpal in the infamous 2013 rape case. The case, documented as State of Goa v. Tarunjit Tejpal, is now positioned for potential escalation in its judicial outcome.
The Goa government is urging the Supreme Court to impose a life sentence on Tejpal, arguing that the ten-year imprisonment term determined by the Bombay High Court is insufficient given the severity of the crime. Importantly, the State’s plea does not contest the High Court’s findings of conviction but is focused solely on revising the sentence severity.
According to the official petition, “The challenge is confined to the quantum of sentence and the direction for concurrent operation of sentences. The State relies only upon the findings and circumstances already recorded by the High Court to demonstrate that the sentence imposed is manifestly inadequate.”
The allegations against Tejpal originated in 2013 when he was accused of sexually assaulting a junior colleague in an elevator at a prestigious hotel in Goa. Following these allegations, the Goa Police filed a First Information Report (FIR) against him, citing multiple offenses, including rape. Tejpal was arrested in November 2013 but was released on bail in July 2014.
The legal proceedings saw a protracted trial that commenced in 2017 and concluded in 2021. In May 2021, the trial court acquitted Tejpal. The presiding judge cited procedural lapses, including significant omissions by the investigating officer and the prosecution’s failure to present crucial evidence, such as CCTV footage, as factors influencing the acquittal.

Dissatisfied with the acquittal, the State of Goa appealed to the Bombay High Court. On August 6, 2023, the High Court overturned the trial court’s decision, resulting in Tejpal’s conviction. The High Court imposed a ten-year prison sentence along with a financial penalty exceeding ₹10 lakh.
