Kerala High Court Intervenes in Teacher Suspension Case
In a significant legal development, the Kerala High Court has temporarily stayed the suspension of a school teacher, Guruprasad Rai K. The suspension was triggered by a quiz question he prepared that identified Vinayak Damodar Savarkar as a freedom fighter who received the ‘most severe punishment’ from the British. This case, titled Guruprasad Rai K v State of Kerala, was presided over by Justice Viju Abraham.
Court’s Decision and Interim Relief
Justice Viju Abraham issued an interim order to stay the suspension for a month, allowing ongoing disciplinary proceedings against Rai to continue. “I’m inclined to pass an interim order staying the operation of P3 order of suspension for a period of one month. But I’m permitting the disciplinary proceedings to continue,” stated the judge. A detailed order from the court is expected soon.
Background of the Case
The controversy stemmed from a school quiz conducted in Kasargode, where a question asked, “Who was the freedom fighter who received the most punishment from the British?” The answer provided was VD Savarkar. This prompted the State’s Education Minister to accuse the question of distorting history, leading to an inquiry and the teacher’s suspension on August 9.
Arguments from Both Sides
Guruprasad Rai K challenged his suspension in the High Court, arguing that it was politically motivated and violated established rules. He contended that the suspension was based solely on the Education Minister’s oral instructions, which he claimed were not compliant with legal protocols. Rai further asserted that the quiz question and its answer were factually accurate, suggesting that the suspension was influenced by societal biases.
The court had earlier requested the State’s response and questioned the necessity of the suspension in this case. Representing the teacher were Advocates KS Bharathan, Aadithyan S Mannali, Ronit Zachariah, Sagith Kumar V, Hemanth H, and S Krishna from the law firm M/s Lawyer & Lawyer. Special government pleader Muhamood TT appeared on behalf of the State.
