Jammu & Kashmir High Court Demands Clarification from Registry Over Rape Victim’s Name Disclosure
The High Court of Jammu & Kashmir and Ladakh has called for an explanation from its registry following an incident where a petition revealed the identity of a rape victim. This action contravenes established legal protocols set to protect the identities of such victims.
Justice Shahzad Azeem took note of this serious breach, emphasizing the necessity to understand how the registry permitted the petition’s filing, given the longstanding directives against disclosing a victim’s identity. These directives are in place to uphold the privacy and dignity of victims involved in sensitive cases.
Justice Azeem remarked, “Considering that the petitioner disclosed the name of respondent No. 2, the victim/complainant, it is imperative to request an explanation from the registry regarding the acceptance of this petition, despite the numerous directions and circulars issued to prevent such occurrences.” His comments underscore the importance of adherence to procedural guidelines designed to prevent victim identification.
The issue was addressed in court on August 18. During the proceedings, the petitioner’s counsel requested to withdraw the petition. The court granted this request, thereby closing this particular case. However, the need for transparency and adherence to legal standards remains a priority for the court.
