Justice Sanjeev Prakash Sharma, the Acting Chief Justice of the Rajasthan High Court, has voluntarily decided to cease his judicial duties. This decision was not influenced by any directives from the Supreme Court but was made independently by Justice Sharma amid ongoing controversy surrounding his position.
Communication with the Supreme Court
According to reliable sources, Chief Justice of India (CJI) Surya Kant was informed of Justice Sharma’s decision via a communication sent to the Supreme Court’s administration. This communication was received by the Registrar General while the CJI was in court, and he was apprised of it only after returning to his chambers.
Protests and Controversy
The situation unfolded as lawyers at the Rajasthan High Court initiated protests, demanding that Justice Sharma be relieved from his duties as Acting Chief Justice and advocating for the appointment of a permanent Chief Justice. The Rajasthan High Court Lawyers Association declared a complete strike until September 6, following an emergency meeting.
Allegations and Supreme Court Involvement
The protests were fueled by allegations from Supreme Court Justice Sandeep Mehta, who accused Justice Sharma of manipulating case listings and abusing administrative powers. Justice Mehta had addressed a letter to CJI Surya Kant, which was initially reported by Bar & Bench. In response, the CJI stated that the Supreme Court Collegium was examining these allegations and assured that Justice Sharma would have the opportunity to respond.
Supreme Court Collegium’s Recommendation
Amidst the controversy, the Supreme Court Collegium recommended Justice Sanjay K Agrawal from the Chhattisgarh High Court for the position of Chief Justice of the Rajasthan High Court. This recommendation is expected to meet the immediate demands of the Rajasthan High Court bar, potentially resolving the unrest among the legal fraternity.
