The Supreme Court of India has issued a directive to Meta Platforms, compelling the restoration of the Facebook and Instagram accounts belonging to the Gujarat wing of the Aam Aadmi Party (AAP). The decision, pronounced on Monday, was delivered by a bench comprising Justice PS Narasimha and Justice Alok Aradhe. The order comes in response to a petition filed by AAP, who sought the reinstatement of their social media presence which had been blocked in the lead-up to local body elections in Gujarat.
Background of the Case
The accounts in question were reportedly restricted following a request from a governmental or law enforcement body, in alignment with Section 79(3)(b) of the Information Technology Act, 2000. This legal provision allows intermediaries to remove access to content under specific circumstances. However, the AAP has contested this action, arguing that they were not provided with a formal notice or rationale for the social media blackout. The party maintains that such an action is a violation of natural justice principles and imposes an undue restriction on political speech.
The Court’s Consideration
The issue was initially brought to the Court’s attention on July 14, with Senior Advocate Shadan Farasat representing AAP. Farasat highlighted that the social media accounts were disabled on April 24, just a day before significant local elections, thereby impacting the party’s outreach efforts. He further stated that AAP was open to removing any specific posts deemed offensive, provided the overall accounts were reactivated.
During this initial hearing, the bench issued a notice to the Union government, seeking clarification on the matter. The Court’s latest ruling now requires Meta to lift the block on AAP Gujarat’s social media accounts, thereby allowing the party to resume its online activities.
