Supreme Court Decision on Goa Nightclub Fire Case
The Supreme Court of India has affirmed the Bombay High Court’s decision to revoke the bail granted to Saurabh Luthra, Gaurav Luthra, and Ajay Gupta, owners of the Birch by Romeo Lane nightclub. The club was the scene of a tragic fire in December 2025 that resulted in the death of 25 individuals.
A bench comprising Justices Dipankar Datta and Sheel Nagu dismissed the appeals filed by the nightclub owners, mandating them to surrender to authorities within a two-week period. The court also emphasized the need for the trial court to expedite the process of framing charges.
Details of the Incident
The catastrophic fire occurred on December 6, 2025, at the Birch by Romeo Lane nightclub located in Arpora, North Goa. Investigations revealed that the nightclub operated without the necessary safety clearances or adequate firefighting equipment. The fire is believed to have started during an indoor fire show conducted without proper precautions. Additionally, authorities discovered that the nightclub was lacking a valid trade license.
Legal Proceedings and Bail Controversy
Following the incident, the Luthra brothers fled to Thailand but were subsequently deported and arrested by Goa Police. Along with other partners, the club’s manager, event organizers, and staff, they were charged under the Bharatiya Nyaya Sanhita (BNS) for offenses including culpable homicide not amounting to murder, acts endangering life, and negligent conduct with respect to fire, compounded by common intention.
An additional sessions court in Mapusa, North Goa initially granted bail to the accused, with Ajay Gupta receiving bail on March 23, and the Luthra brothers on April 1. However, the State of Goa contested this decision, leading to the High Court’s intervention. Justice Neela Gokhale of the Bombay High Court allowed the State’s appeal on August 19, and subsequently canceled the bail.
