High Court Intervenes in Custodial Dispute
The Allahabad High Court has ruled in favor of granting permanent custody of a young girl to her father, following allegations that the mother had coached the child to falsely accuse her father of sexual misconduct. Justice Sandeep Jain presided over the case, emphasizing the child’s clear preference to live with her father, a factor that significantly influenced the court’s decision.
Temporary Custody Influences Permanent Decision
The court initially granted temporary custody of the five-year-old to her father in July. It was observed that the child appeared content, secure, and well-cared for during this period. Based on these observations, the court subsequently awarded permanent custody to the father, who is a medical professional. However, the court ensured that the mother was granted visitation rights, allowing her to maintain contact with her daughter.
Allegations of Coaching and Misconduct
The case was brought forth through a Habeas Corpus petition filed by the father in June. He claimed that his wife was obstructing his access to their daughter and had influenced her to make baseless accusations. According to the father, the child was exposed to inappropriate content by her mother, which was beyond her comprehension due to her young age. In July, after interacting with the child, the court noted that she was being manipulated amidst the parental conflict.
“The evidence suggests that the child has been heavily influenced by her mother, rendering her claims of abuse unreliable,” the court stated on July 9. It was determined that the environment with the mother was not conducive to the child’s well-being, prompting the transfer of custody to the father.
Child’s Well-Being and Court’s Final Decision
In a subsequent interaction on August 17, the court found the child to be happy and comfortable living with her father and paternal grandparents in Amravati, Maharashtra. She expressed a strong emotional bond and a desire to remain in her father’s care, a sentiment that played a pivotal role in the court’s final decision.

The father, who secured an ex parte divorce from his wife, assured the court of his ability to meet the child’s needs and provide a stable environment. Despite opposition from the mother, who contested the legitimacy of the divorce, the court decided in favor of the father, emphasizing the child’s preference and emotional attachment.
