A significant development unfolded on Monday when a Delhi court granted bail to Kesar Negi, a cook implicated in the tragic fire incident at a Malviya Nagar hotel. The fire, which occurred on June 3 at Flourish Stays B&B in Hauz Rani, resulted in the loss of 22 lives, including those of 13 foreign nationals.
The decision to release Negi on bail was made by Additional Sessions Judge Samar Vishal at the Saket Courts. This ruling came after an earlier decision by Judicial Magistrate Bhanu Pratap Singh on June 8, which denied Negi’s bail and prompted him to seek relief from the sessions court.
The prosecution had accused both the hotel owner, Lovkesh Bajaj, and Negi of negligence, leading to the catastrophic incident. However, Negi contended in his bail plea that he was wrongfully targeted as a scapegoat, arguing that the true issue lay in systemic safety lapses and statutory violations by the hotel’s proprietors. He asserted that his role as a salaried chef did not encompass responsibilities over the hotel’s fire safety measures.
According to Negi’s defense, the fire was triggered by a short circuit, which caused the wiring to overheat and the pipes to melt. In his statement to the court, Negi recounted his immediate reaction to turn off the electricity upon recognizing the electrical fault as the source of the blaze. His legal team, comprising advocates Deepak Prakash, Sriram Parakkat, Priyamvada Singh Solanki, and Harshit Sharma, emphasized that Negi was an elderly and frail individual from Uttarakhand, fulfilling the criteria necessary for bail consideration.
This case highlights the complexities involved in assigning accountability in incidents of such magnitude, where multiple layers of responsibility and compliance with safety regulations are scrutinized.
