The Delhi High Court has instructed the Delhi government to accelerate the appointment process for filling vacancies within the Real Estate Regulatory Authority (RERA). This directive was issued by a Division Bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia, who mandated the government to submit an affidavit concerning these appointments within a fortnight.
“We direct that the process of filling up the posts be expedited,” the Bench stated. “File an affidavit in two weeks and ensure that at least the judicial members are appointed.” The court’s decision came in response to a petition by advocates Aishwary Jain and Deeptanshu Jain, who sought interim relief to allow outgoing Delhi RERA Chairperson Anand Kumar to remain in office until a successor is appointed.
The petition highlighted that the Chairperson’s position became vacant on August 11, 2026, following Anand Kumar’s retirement upon reaching the age of 65. Furthermore, a member’s post has remained unfilled since December 2025. The petitioners argued that the Selection Committee has not been consulted as required under Rule 17 of the Delhi RERA Rules, 2016, hindering the adherence to the 90-day selection timeline specified in Section 24(3) of the RERA Act.
Representing the petitioners, Senior Advocate Sanjeev Sagar emphasized that RERA needs a Chairperson, a judicial member, and a technical member to function effectively. Currently, only a technical member is in office since the Chairperson and judicial member have vacated their positions.
In defense, the counsel for the Delhi government informed the Bench that the tenure extension proposal for the outgoing Chairperson was declined on August 11. However, efforts to appoint a new Chairperson are actively underway. Additionally, the selection process for the judicial member has concluded, with the government awaiting the Selection Committee’s recommendation.
