Hyderabad Court Grants Interim Bail to Union Minister’s Son in POCSO Case

In a recent legal development, a Hyderabad court has granted interim bail to Bandi Sai Bageerath, the son of Union Minister of State for Home Affairs Bandi Sanjay Kumar. The bail, granted under compelling circumstances, pertains to charges filed under the Protection of Children from Sexual Offences (POCSO) Act. As reported by PTI, this temporary relief was extended to facilitate Bageerath’s participation in his Bachelor of Business Administration (BBA) examinations.

Bageerath was detained in judicial custody before receiving this temporary reprieve, which is effective until June 25. During this period, he is expected to take three scheduled examinations. Following the conclusion of these exams, he is required to return to custody, pending further judicial proceedings.

The case was initiated on May 8, following a complaint lodged by the mother of a young girl, who alleged that her daughter was sexually assaulted. In the wake of these allegations, Bageerath was arrested in mid-May and subsequently detained at Cherlapally Central Prison. The investigation into these allegations remains active and ongoing.

Prior to his arrest, Bageerath sought legal recourse by approaching the Telangana High Court, seeking protective relief from arrest. His legal counsel presented arguments challenging the applicability of the POCSO Act, citing ambiguity regarding the complainant’s age and asserting that the relationship was consensual. However, the prosecution and the complainant held firm in their stance, asserting that the girl was indeed a minor, thereby warranting the stringent application of the POCSO Act.

The Telangana High Court, after reviewing the material on record, declined to grant interim protection from arrest to Bageerath. The court expressed its reluctance to interfere at that juncture, especially given the gravity of the allegations involved. This decision underscored the court’s commitment to a thorough examination of the facts, ensuring that justice is served in accordance with the legal framework governing such cases.
