Jammu Court Denies Bail in Attempted Rape Case
In a recent legal proceeding, a Jammu court has refused to grant bail to a man accused of attempting to rape his elderly, widowed mother. Presiding Judge Amarjeet Singh Langeh highlighted the presence of prima facie evidence implicating the suspect in serious offenses, including attempted rape, sexual harassment, and outraging the modesty of a woman.
The court noted the accused allegedly engaged in acts of indecent exposure, threatening behavior, and violence against his mother. Specifically, the accused reportedly exposed himself, threatened to urinate on her face, and tore her clothes with the intention of rape. The incident was partially documented through a video clip recorded by the victim’s granddaughter, who is also the accused’s niece. The video evidences the accused unzipping his pants and exposing himself to the victim.
Prima Facie Evidence and Court Observations
Judge Langeh emphasized that the evidence presented showed clear involvement of the accused in these non-bailable and grave offenses. According to the prosecution, the accused, who is a businessman, entered his mother’s home on July 28, assaulted her using a piece of a broken door, and declared his intention to fulfill a dream of having sexual relations with her.
The accused contended that he was wrongfully implicated due to a family feud over ancestral property. He claimed that his sister, who lodged the complaint, was embroiled in a marital dispute and sought to secure the entire share of the family property through their mother.
Court’s Rationale for Bail Denial
The court strongly condemned the accused’s actions, labeling them as a severe breach of human dignity, familial trust, and the sanctity of the maternal bond. The bench remarked that irrespective of familial discord, such egregious conduct cannot be tolerated. The court further noted that releasing the accused could pose a direct threat to the physical and psychological well-being of the victim and other witnesses, given their close familial relationships.
It was also revealed that a previous bail application had been rejected by the Sub-Judge (Judicial Magistrate First Class), Jammu on August 14. The current application was deemed to lack new circumstances that would justify a different outcome.
Senior Advocate Sunil Sethi and advocate Navyug Sethi represented the accused in court, while Additional Public Prosecutor Ajay Dogra appeared for the Union Territory of Jammu and Kashmir. Advocate Manpreet Singh Saini represented the complainant.
