In a significant development, Acting Chief Justice Sanjeev Prakash Sharma of the Rajasthan High Court has voluntarily refrained from participating in judicial proceedings. This decision comes in the wake of mounting protests against him by the legal community.
According to the newly established roster, finalized by Justice Sharma himself, he will not be part of any bench or assigned regular judicial hearings from September 1 to September 5. The reallocation of cases previously under his purview to other benches underscores this shift in judicial responsibilities.
The decision to step back follows calls from lawyers who have expressed dissatisfaction with Justice Sharma’s continued role as acting Chief Justice, advocating instead for the appointment of a permanent Chief Justice. Demonstrations have been held by the Rajasthan High Court Lawyers Association, who commenced a complete strike until September 6 following an urgent general assembly meeting.
On Monday, the association resolved to send formal communications to the Chief Justice of India, Surya Kant, and the President of India, reinforcing their demands. The protests, which included slogan-shouting and intervention by law enforcement at both the Jaipur and Jodhpur High Court premises, depict the strong opposition faced by Justice Sharma.
The situation further intensified due to allegations made by Supreme Court Justice Sandeep Mehta against Justice Sharma. Justice Mehta’s communication to CJI Surya Kant accused Justice Sharma of manipulating case listings and misusing his administrative authority. Justice Mehta advocated for appointing a Chief Justice from a different state to lead the Rajasthan High Court promptly.
In response, the Chief Justice of India indicated that the Collegium is actively investigating these allegations. It has been affirmed that Justice Sharma will be given an opportunity to present his side before any decisions are finalized.
This chain of events has catalyzed the legal fraternity to demand Justice Sharma’s removal from his acting Chief Justice duties, reflecting a critical juncture for the Rajasthan High Court’s administrative and judicial dynamics.
