Calcutta High Court Halts Police Action Against TMC MLA Paresh Ram Das

In a significant judicial development, the Calcutta High Court has restrained the West Bengal Police from initiating any coercive measures against Trinamool Congress MLA Paresh Ram Das. This decision was rendered by Justice Saugata Bhattacharyya in response to a petition filed by Das after six First Information Reports (FIRs) were lodged against him on May 16 at the Canning Police Station.

Interim Protection Granted

The court’s order provides temporary relief to Das, safeguarding him from coercive actions solely concerning the six FIRs until June 30, 2026. Justice Bhattacharyya’s ruling emphasized that investigations should proceed according to legal protocols, with Das expected to fully cooperate with the investigative authorities. The interim protection is contingent upon his compliance, with the state having the option to request a revocation should Das fail to cooperate.

Examination of FIRs

Upon reviewing the cases, the court observed that five of the FIRs pertained to events dating back to 2021. The legitimacy of the sixth FIR was called into question, as the court noted discrepancies in the manner in which Das’s name appeared in the complaint. Justice Bhattacharyya remarked that the investigation was still in its early stages and refrained from making further observations on this matter.

Senior Advocate Kishore Datta, representing Das, argued that the FIRs were politically motivated, arising from the recent shift in governmental power in West Bengal. He highlighted that the majority of the complaints originated from incidents in 2021. In contrast, Additional Advocate General Rajdeep Mazumder maintained that the FIRs involved serious allegations, although the court proceeded to grant Das interim protection.

Conclusion

This legal intervention by the Calcutta High Court underscores the judiciary’s role in balancing investigative processes with individual rights, especially in politically sensitive cases. The court’s decision ensures that while investigations continue, the accused is protected from immediate coercive actions, provided they comply with legal procedures.
