The Supreme Court of India issued a significant reminder to the legal fraternity on Wednesday, emphasizing that adjournment slips should not be misconstrued as automatic approvals for postponing court cases. The ruling underscores the authority of the Court to decide whether a case may be adjourned, regardless of any adjournment slips filed by the parties involved.
The bench, composed of Justice Ahsanuddin Amanullah and Justice R Mahadevan, delivered this directive during a proceeding where a lawyer argued for a case to be deferred, citing an adjournment slip submitted by the respondents. Justice Amanullah addressed this assumption directly, stating, “It is up to us whether or not we allow adjournment. You have to come prepared and argue. If we allow, only then is it adjourned. This is a message to the bar.”
In a reiteration of the Court’s stance, the justices made it clear that the responsibility lies with the attorneys to be fully prepared to proceed with their cases irrespective of any pending adjournment requests. The decision to grant an adjournment rests solely with the Court’s discretion.
During the hearing, when the petitioner’s counsel sought a different date for the proceedings, the bench initially suggested that the matter would be considered later in the day. However, upon further request from the counsel, the Court agreed to reschedule the hearing for the following week.
This decision sends a strong message to the legal community about the necessity of readiness and preparedness in legal proceedings. It serves to reinforce the principle that the judiciary has the ultimate authority over the scheduling and adjournment of cases, ensuring that judicial processes are not unduly delayed.
