In a recent legal development, Flipkart, a leading e-commerce platform, has approached the Karnataka High Court to contest a penalty of ₹5 lakh imposed by the Central Consumer Protection Authority (CCPA). The penalty was levied on the grounds of selling toys that did not meet the standards set by the Bureau of Indian Standards (BIS). The case has been titled Flipkart Internet Private Limited v. Central Consumer Protection Authority.
Legal Proceedings and Arguments
During the court proceedings, Justice Suraj Govindaraj served notice to the CCPA. He posed a probing question to Flipkart’s counsel regarding the company’s hesitance to settle the relatively modest penalty. “This is a small amount of ₹5 lakh, do you want us to increase it?” he inquired.
Representing Flipkart, Senior Advocate Vikram Huilgol expressed that the company was reluctant to pay the penalty as it might imply an admission of guilt. “Paying the fine appears as an admission of guilt. We are willing to pay under protest, but we request the court to consider our challenge against the CCPA order,” Huilgol stated.
Justice Govindaraj suggested that acknowledging the mistake might be more prudent for Flipkart. “Everyone makes mistakes. Admit it and move forward. Otherwise, there is a risk that the penalty could be increased,” the judge remarked.
Jurisdictional Concerns and Compliance Issues
Huilgol further argued that the CCPA lacked jurisdiction to penalize Flipkart, as the BIS Act already prescribes a separate authority for ensuring compliance with BIS standards. “At worst, this is a BIS Act violation handled by a different regulatory body,” he added.
The court acknowledged the CCPA’s finding that Flipkart’s “assured” tag on non-compliant toys might mislead consumers into believing that the products were quality-verified. “These toys are for children, who may put them in their mouths. If the plastic is substandard, the consequences could be severe. This is a matter of corporate responsibility,” the court emphasized.
Next Steps and Compliance Measures
Huilgol clarified that there was no allegation of dangerous materials in the toys, only non-adherence to BIS standards. The court, while issuing notice, recorded Flipkart’s agreement to pay the penalty under protest. The company was also instructed to file an affidavit detailing measures taken to ensure BIS compliance for all products sold on its platform.
Additionally, the court highlighted the CCPA’s directive that Flipkart must prominently display the contact information of a grievance officer on its website. This requirement was stressed as crucial for consumer protection.
The matter is scheduled for further hearing on October 6, where Flipkart’s compliance efforts and jurisdictional arguments will be reviewed in greater detail.
