Kerala High Court Grants Bail in Drug Trafficking Case
The Kerala High Court has granted bail to school teacher Kavya K, who was arrested in connection with a drug trafficking case in Vadakara. The decision was handed down by Justice Kauser Edappagath on Wednesday, in the case titled Kavya K v State of Kerala.
Court Considers Length of Custody and Investigation Status
Kavya, aged 29, was identified as the third accused in the case. The Court took into account her judicial custody since July 25 and noted that the investigation was nearly complete. Justice Edappagath stated, “The applicant was remanded to judicial custody on 25.07.2026. The investigation is almost over. The recovery has been effected. The applicant has no criminal antecedents. For these reasons, I do not find any reason to hold that the continued detention of the applicant is required for any purpose. Hence, the applicant is entitled to be released on bail.”
Charges Under NDPS Act
The bail application was filed pertaining to charges under Section 22(b) and Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). These charges relate to possession of psychotropic substances and criminal conspiracy. Prosecutors alleged that Kavya and her co-accused planned to transport and sell narcotic drugs.
During the investigation, police reportedly discovered 2.108 grams of MDMA, a synthetic drug commonly known as ecstasy, with one of the accused. It was also alleged that Kavya’s bank account and that of another accused were used for financial transactions linked to the crime.
Defense and Court’s Conditions for Bail
Kavya maintained her innocence, arguing that she was falsely implicated and that there was no evidence linking her to the crime. The prosecution, however, contended that her involvement was deliberate. Despite this, the Court granted bail, citing the completion of the investigation and her clean record.

As part of the bail conditions, Kavya is required to execute a bond of ₹1 lakh with two solvent sureties. She must also appear before the investigating officer every Saturday and cooperate fully with the investigation. Furthermore, she is prohibited from contacting any witnesses or tampering with evidence and cannot leave Kerala without permission from the trial court.
