Mumbai Court Ruling on Cheque Bounce Case Involving Kerala MLA

In a notable legal proceeding, the Mumbai court has delivered a decisive verdict against Kerala’s Member of the Legislative Assembly (MLA) from the Pala constituency, Mani C Kappan. The case, [Dinesh Menon v Mani C Kappan], saw Kappan convicted under Section 138 of the Negotiable Instruments Act, 1881, concerning a cheque dishonour claim filed by businessman Dinesh Menon.

Presiding over the matter, Judge S.A. Khalane sentenced Kappan to one year of simple imprisonment. Furthermore, the court mandated that Kappan pay ₹1.20 crore in compensation to Menon, accompanied by an interest rate of 9% from the date of the judgment until the total amount is settled. Should Kappan fail to comply with the compensation directive within one month, the court stipulated an additional imprisonment period of six months.

To enforce the ruling, the court has issued a standing non-bailable warrant (NBW) for Kappan’s arrest, to be executed by the relevant police authorities. This case arose amid a protracted financial conflict between Kappan and Menon, which has also led to other legal challenges for Kappan.

Beyond the cheque dishonour case, Kappan has been embroiled in separate legal issues concerning allegations of cheating and criminal breach of trust in Kerala. Although the Kerala High Court previously chose not to intervene in the framing of charges, a special court in Ernakulam ultimately acquitted Kappan of such criminal allegations in February 2025.

The cheque bounce case in Mumbai, however, continued independently and has now reached its conclusion with today’s verdict. The detailed order regarding this judgment is awaited, marking a significant moment in the ongoing legal narrative involving MLA Mani C Kappan.
