Supreme Court Steps In to Ensure Qualified Teachers in Assam
On Tuesday, the Supreme Court of India issued an interim order to prevent the appointment or retention of unqualified teachers in educational institutions across Assam. This significant ruling was delivered by a bench comprising Chief Justice of India Surya Kant, alongside Justices Joymalya Bagchi and V Mohana. The directive was pronounced in response to a case scrutinizing Assam’s teacher provincialisation scheme.

The court explicitly stated, “As an interim measure, it is directed that no teacher shall be appointed or absorbed in schools or colleges unless such candidates possess the requisite prescribed qualifications under the Right of Children to Free and Compulsory Education Act, 2009, the National Council for Teacher Education Act, 1993, or the University Grants Commission Act, 1956, until further orders.” This move is part of a broader effort to ensure that educational standards are maintained across the state.

This practice was later legitimized through a 2018 amendment to the 2017 Act, which is under scrutiny.
High Court’s Previous Ruling
The Gauhati High Court, in the case of Mohor Ali Sheikh and Others v. State of Assam, previously evaluated the constitutional validity of the provincialisation scheme. In its judgment dated October 4, 2024, a division bench instructed the state to establish a regular pay scale for affected teachers, aligning with the governing Act’s schedule. The High Court also observed that unqualified teachers should continue to receive their full salaries.
