Kerala High Court’s Directive to Address Staff Shortage in Consumer Commissions
The Kerala High Court has issued a directive to the State government, urging the establishment of 229 staff positions to enhance the operational infrastructure of Consumer Dispute Redressal Commissions across the state. This decision arose during the hearing of a Public Interest Litigation (PIL) filed by Advocate J Surya, alongside a related petition by CK Mithran, concerning the functionality and infrastructure of these consumer commissions.
The bench, comprising Chief Justice Soumen Sen and Justice Syam Kumar VM, emphasized the necessity for these new posts to bolster the infrastructural development of Consumer Dispute Redressal Commissions at both state and district levels. The case citation is Adv J Surya v State of Kerala & ors, along with the connected case.
Previously, the Court had implemented an interim measure to mitigate the staff shortage, as per its order dated August 5, 2026. This arrangement entailed assigning existing civil police officers, who were already designated for court duties in magistrate and sessions courts, additional responsibilities within consumer commissions throughout the state. This interim solution will remain in effect until the proposed staff positions are established.
Awaiting Financial Sanction for New Posts
During the proceedings on September 9, the Court was informed by the Special Government Pleader that the proposal for creating these posts was pending financial approval. A financial sanction is anticipated within four weeks. Acknowledging this update, the Court scheduled further consideration for October 7, instructing the State to expedite the creation of these posts by that date.
Moreover, the Court requested the State to submit an affidavit outlining the progress made towards establishing these positions. “We hope that, by the adjourned date, effective steps shall have been taken for the creation of the posts,” the Court remarked. The legal representation included Advocates R Rajasree (Chuttimattathil), AB Beenu, and Aparna Rajan for Surya, and Advocate Rinu S Aswan for Mithran.
