The Delhi High Court has issued a significant order protecting the personality rights of Ravi Kishan, a notable actor and politician. The court’s decision mandates the removal of unauthorized content exploiting Kishan’s image and persona. Justice Jyoti Singh has prohibited the dissemination of defamatory or vulgar material linked to Kishan’s identity and traits.
In a decisive move, Justice Singh directed major social media platforms, including Google, Meta, and X Corp, to delete any related web links within 72 hours. This directive comes into play if the original uploaders or domain name registrars fail to comply with the takedown request within three days of the court’s July 2 ruling.
The interim order emerged from a legal suit filed by Kishan, who sought to safeguard his personality rights. He requested the court’s intervention to stop the distribution of AI-generated derogatory content across various websites and social media channels. Among the contentious material was a radio show segment titled ‘What is Love with Kavi Kishan,’ broadcasted on Ishq 104.8 FM. Kishan argued that the program unlawfully utilized his name, image, and likeness for commercial gain without his consent. Additionally, he pointed out an AI-generated video parodying him on IshqFM’s Instagram account.
The court has enforced an injunction against Creative Channel Advertising and Marketing Private Limited, also known as Manoranjan TV Network, which owns Ishq 104.8 FM. This provisional order extends to other parties, including unidentified entities, suspected of uploading the infringing content.
The case is scheduled for further proceedings on October 15. Senior legal counsels N Hariharan and Sanjay Upadhaya, along with advocates Neeraj Grover, Krishna Kumar Shukla, Madhav Anand, Pranav Prasoon, Alvin Antony, Mansi Bachani, Kunal Khanna, and Kartik Mitra, represented Kishan in this matter.
