Supreme Court Invites Public Input in Ram Mandir Fund Investigation
The Supreme Court of India has taken notable steps to ensure transparency and thoroughness in the ongoing investigation of the alleged misappropriation of funds collected for the Ayodhya Ram Mandir construction. In a recent hearing, the court has extended an invitation to petitioners and concerned citizens to contribute their insights to the Special Investigation Team (SIT) through the office of the Solicitor General.
Case Background and Court’s Directive
A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana deliberated on a collection of petitions demanding a Central Bureau of Investigation (CBI) probe into the alleged fund embezzlement. The petitions argue that a CBI investigation, under the direct supervision of the Supreme Court, is crucial for ensuring justice.
The bench, however, has presently upheld the ongoing probe by the SIT, which includes a forensic auditor, and has tasked it with submitting a status report to the Supreme Court in a sealed cover. This report will be reviewed by the court to decide its release to the involved parties.
Public Participation and Accountability
The Supreme Court has emphasized the importance of community involvement in the investigation. “We also permit the petitioners or any other bona fide public-spirited person to give their suggestions to the office of the learned Solicitor General with respect to the aspects that may be required to be thoroughly investigated by the SIT,” stated the court.
The court assured that all suggestions received will be forwarded to the SIT and will be considered objectively. Moreover, the SIT is accountable to the court, which reserves the right to provide further instructions if necessary.
Discussion on Investigation Transparency
During the proceedings, a petitioner’s counsel requested access to the investigation materials to assist the court effectively. However, Solicitor General Tushar Mehta opposed this request, asserting that such materials cannot be disclosed to non-participants in the investigation.
This was countered by the petitioner’s counsel, who argued for the public’s right to transparency, given that the petition represents the interests of the people of India.
The court was also informed about statements made by Uttar Pradesh Chief Minister Yogi Adityanath regarding the SIT findings, which were made publicly while the matter remains sub-judice.
Future Directions and Court’s Assurance
Chief Justice Surya Kant acknowledged the possibility of issuing additional directions to the SIT if the investigation requires qualitative improvements. “If the SIT is doing the job satisfactorily, that’s a different issue. But if you think they are wanting in any manner and qualitative improvement is required, we are open-minded. We can issue additional directions,” said CJI Kant.
In light of the ongoing investigation, the court has adjourned further hearings to a future date, allowing time for submission and review of suggestions by the SIT.
