Delhi Court’s Bail Decision in Janakpuri School Case
A Delhi court has recently approved bail for a teacher implicated in the alleged rape of a three-year-old girl at a private school in Janakpuri. This decision came from Additional Sessions Judge Rohit Gulia of the Dwarka courts, who highlighted the absence of physical injuries on the child.
Judge Gulia observed that the medical examination report of the child did not indicate any harm or marks on her body, including her private areas. Furthermore, the judge noted that the accused teacher was not the sole adult present at the time of the alleged incident, as another class teacher was also present in the classroom.
“While it is acknowledged that the child was under the supervision of the accused during her time at school, another teacher was also present. Moreover, the medical report does not show any signs of injury,” stated Judge Gulia in the order dated May 20.
Case Background and Arrests
The case began with a police complaint filed by the minor’s mother on May 1. Following the complaint, a 57-year-old school clerk was arrested under the Protection of Children from Sexual Offences Act, 2012 (POCSO Act), and placed in judicial custody. He was released on bail within a week, a decision the Delhi Police contested by moving to the High Court, which has since requested a response from the accused regarding the bail cancellation plea.
The teacher’s involvement surfaced during the investigation, leading to her arrest on May 13. She sought bail, claiming she was wrongfully accused, and argued that her inclusion in the case was an afterthought to broaden the prosecution’s scope.
Court’s Considerations and Conditions
The court, after reviewing the circumstances, granted bail to the teacher. It was noted that the child had not mentioned her teacher’s involvement to her mother or the doctor, nor was her name included in the original complaint. Judge Gulia remarked that the investigation concerning the teacher was concluded, negating the need for her continued judicial custody.
The court imposed a condition that the teacher must refrain from attending school until the trial concludes. Additionally, the teacher’s lawyer was instructed to advise her family against making any derogatory comments about the victim on social media.
