The Delhi High Court recently saw the resolution of a trademark infringement case concerning the use of the name ‘Vasant Valley’. The case was initiated by Education Today Trust, owned by Aroon Purie, which operates the prestigious Vasant Valley School in New Delhi. The dispute was against a Telangana-based school accused of unauthorized use of the ‘Vasant Valley’ trademark.
In the legal proceedings, Education Today Trust alleged that the Telangana institution was infringing upon its trademark rights by using the ‘Vasant Valley’ name without permission. The dispute was amicably resolved when the Telangana school agreed to cease the use of the name.
Justice Tushar Rao Gedela of the Delhi High Court endorsed the settlement agreement between the parties on May 12, thereby closing the case. As per the agreement, the Telangana school provided an undertaking not to use ‘Vasant Valley’ or any confusingly similar mark. The school committed to removing the trademark from all materials, including goods, banners, hoardings, stationery, uniforms, catalogues, and brochures by June 30.
Furthermore, the Telangana institution agreed to initiate a name change by submitting the necessary application to the Education Department of Telangana or the Telangana State Board of Secondary Education within thirty days of the court order. The school also confirmed the permanent removal of its website, social media profiles, Just Dial page, and YouTube channel that contained the ‘Vasant Valley’ name. Additionally, it pledged not to use any domain names incorporating ‘Vasant Valley’ in the future.
Both parties jointly clarified that the Telangana school had no association with the Delhi institution. Consequently, the Delhi school agreed not to pursue any claims for damages. The court decreed the suit in accordance with the settlement agreement, reinforcing that both parties remain bound by its terms.
Senior advocates Rajiv Nayar and Nakul Dewan, along with advocates Ketan Gaur, Ankit Pal, Utsav Saxena, Maujina Dasgupta, and Satyendra from Trilegal, represented the complainant, Education Today Trust. Advocate Lokesh Kumar Sharma appeared for the Vasant Valley Concept School, while advocates Varun Pathak, Akhil Shandilya, and Vishwajeet Deshmukh represented other parties involved.
