The esteemed Delhi Gymkhana Club has initiated legal proceedings in the Delhi High Court, contesting a directive issued by the Central government which mandates the club to vacate its expansive 27.3-acre property located in the prestigious Lutyens’ Delhi by June 5. This legal move was presented to Justice Avneesh Jhingan by Senior Advocate Abhishek Manu Singhvi, who emphasized the need for an expedited hearing. Justice Jhingan has consented to schedule the hearing for May 26, a Tuesday.
Background of the Eviction Order
On May 22, the Land and Development Office (L&DO) issued a notification to the Delhi Gymkhana Club, demanding the relinquishment and transfer of its premises situated at 2, Safdarjung Road. This decision was based on clause 4 of the original lease agreement, which empowers the government to reclaim possession of the property if it is deemed necessary for a ‘public purpose.’
Government’s Justification
The government has cited the necessity of the land for enhancing and safeguarding the defense infrastructure, as well as for governance and other critical public security objectives, given its proximity to the Prime Minister’s residence and other high-security areas in Lutyens’ Delhi. According to the order, upon re-entry, the entire parcel of land, including all associated buildings, structures, lawns, and installations, will be wholly transferred to the Lessor, represented by the President of India through the Land & Development Office.
