Delhi High Court Concludes Hearings on BCD Election Disputes

The Delhi High Court has reserved its decision on a series of petitions alleging misconduct in the Bar Council of Delhi (BCD) elections. A Division Bench, comprised of Justices Anil Kshetarpal and Tejas Karia, conducted hearings over the weekend. The hearings included testimonies from multiple petitioners and respondents.

Supreme Court Involvement

These proceedings follow a directive from the Supreme Court of India. On May 18, a Bench led by Chief Justice of India (CJI) Surya Kant and Justice Joymalya Bagchi directed the Delhi High Court to appoint a special bench for these cases. The Supreme Court previously suspended ballot counting due to concerns about potential tampering.

Election Oversight and Allegations

The BCD elections, held in February, were overseen by retired Delhi High Court judge Justice Talwant Singh, who acted as the returning officer. Despite these measures, the elections were marred by allegations of misconduct. Reports of ballot tampering and breaches of the Model Code of Conduct (MCC) led to the suspension of 67 candidates, including two Senior Advocates.

The BCD faced further complications when 79 lawyers were served suspension notices. However, 63 of these suspensions were later revoked after explanations were provided by the affected individuals. Additional discord arose when the Bar Council of India suspended a lawyer for inappropriate conduct towards Justice Talwant Singh, accusing him of inciting hostility and disrupting election procedures.

Subsequent Developments

Further tensions led to the suspension of former Delhi High Court Bar Association President Rajiv Khosla and nine other advocates for allegedly assaulting election officials. On May 2, Justice Singh sent a confidential report to the Supreme Court detailing these events. Meanwhile, several petitions have been filed to address the alleged irregularities in the election process.
