A Law Teacher's Insight on Ethical Challenges for Graduating Students

Introduction

As another batch of BA.LL.B. students prepares to leave the academic world and enter the legal profession, a reflective law teacher shares his thoughts on the challenges and ethical dilemmas his students may face. This June marks the completion of their academic journey, and the beginning of their careers as legal professionals. While we, as educators, strive to equip them with the fundamental skills of the profession, the journey ahead will test their ethical compass and commitment to justice.

From Classroom Idealism to Courtroom Pragmatism

The idealism that drives many students to pursue law often stems from a desire to address societal injustices. However, as they transition from the idealistic environment of academia to the pragmatic world of legal practice, the real challenge lies in maintaining their ethical integrity. The question is whether they will continue to uphold the values instilled in them or succumb to the pressures of professional pragmatism.

Professional Ethics: Teaching vs. Practicing Law

The ethical obligations of a law teacher and a practicing lawyer often diverge. Teachers are tasked with fostering idealism and a passion for justice, while the legal profession sometimes demands a focus on client interests, which may not always align with broader ethical considerations. This dichotomy raises concerns about how students will navigate these conflicting dimensions in their careers.

Societal Expectations and Reward Mechanisms

There is a stark contradiction between societal expectations and the rewards offered to legal professionals. While society desires a just legal system, it often rewards lawyers based on material success rather than their contributions to justice. This discrepancy can discourage young lawyers from pursuing socially impactful cases, as financial incentives may lead them elsewhere.

The Consequences of Ethical Neutrality

The trend towards ethical neutrality has led to the commercialization of the legal profession. With a significant portion of the population unable to afford legal representation, access to justice becomes a privilege rather than a right. This commercial approach to law risks turning the courtroom into a space where financial capability dictates the quality of justice received.

A Teacher’s Hopes and Expectations

In keeping with tradition, the teacher asks for a simple gesture from his students—a cup of tea as gurudakshina—symbolizing the hope that they will uphold ethical values in their practice. He wishes to meet them five years down the line, to hear their stories of maintaining integrity in the face of challenges. The teacher’s ultimate goal is to inspire students to choose paths that align with their conscience, even when faced with difficult choices.

Adnan Asrar, an Assistant Professor at Lloyd Law College in Greater Noida, shares these insights, hoping to inspire the next generation of lawyers to remain steadfast in their pursuit of justice.
