Justice Yogesh Khanna Named Acting Chairperson of NCLAT
The Central Government has officially appointed Justice Yogesh Khanna as the acting chairperson of the National Company Law Appellate Tribunal (NCLAT). This appointment follows the retirement of Justice Ashok Bhushan, who served as the chairperson until July 4. According to a notification released by the Ministry of Corporate Affairs on July 8, Justice Khanna’s tenure as the officiating chairperson commenced on July 5.
Justice Khanna’s appointment is set for a term of three months, or until a permanent chairperson is appointed, or until further notice, whichever comes first. Prior to his current role, Justice Khanna has been a judicial member of the NCLAT since February 19, 2024. Before his involvement with the NCLAT, he served as a judge at the Delhi High Court. His tenure as a permanent judge began on November 8, 2016, and concluded upon his retirement on December 30, 2023.
Justice Khanna’s legal career originated in the district courts of Delhi in 1986. He advanced to the Delhi Higher Judicial Service in 2000, where he served as a District Judge at the Rohini courts in Delhi. Notably, he presided over the high-profile 2012 Delhi gang rape and murder case, where he sentenced the four adult convicts to death as an additional sessions judge.
His appointment comes at a pivotal time for the tribunal, as it anticipates further changes in the composition of its bench. Justice Sharad Kumar Sharma, another judicial member, is expected to transition from the Chennai bench to the principal bench in New Delhi starting July 20. Additionally, Justice N Seshasayee, who joined the NCLAT as a judicial member last year, is likely to move from Delhi to the Chennai Bench.
