Supreme Court Raises Alarm Over Threats to Judges and Their Families

The Supreme Court of India has voiced strong concerns regarding the increasing threats and attacks faced by judges and their families. This issue gained prominence following reports of intimidation directed towards retired Bombay High Court judge, Justice GS Patel, and his family. The Bench, comprising Justices Satish Chandra Sharma and Sanjeev Sachdeva, highlighted the profound impact such incidents could have on the justice system, potentially deterring judges from executing their duties without fear.

The Court was addressing a bail application filed by Priyanshu Singh, accused of orchestrating an attack on a judicial officer’s home in Madhya Pradesh. The Bench underscored the gravity of the matter, noting that any form of intimidation against judges for fulfilling their duties could have far-reaching consequences on the administration of justice.

Case Background: Attack on a Judicial Officer in Madhya Pradesh

The Supreme Court’s remarks emerged during the hearing of Priyanshu Singh’s bail plea. Singh, who has been detained for over seven months, faces serious allegations related to vandalism at the residence of a magistrate. According to the prosecution, the attack occurred after Singh’s previous bail request was denied. Allegedly, he conspired with accomplices to assault the judicial officer’s home, inflicting property damage and issuing threats.

The prosecution presented CCTV evidence purportedly placing Singh at various sites linked to the incident, including the magistrate’s residence. The State argued that the actions amounted to an obstruction of justice and should not be taken lightly.

Justice GS Patel and Family Under Threat

Justice GS Patel reportedly faced threats following his judgment in the Dawoodi Bohra leadership dispute in April 2024. Reports suggest that his family, including his daughter residing in London, has been subjected to intimidation and violence, prompting investigations in both India and the UK. In response to these threats, UK law enforcement has been providing security to Justice Patel’s family in London.

Supreme Court’s Stance on Bail Application

During the hearing, Singh’s legal representative contended that Singh had been detained for a significant period and was arrested based on suspicion rather than conclusive evidence. Despite acknowledging the seriousness of the allegations, the defense argued the lack of direct evidence against Singh.

However, the Supreme Court Bench expressed skepticism regarding these claims, emphasizing Singh’s alleged leadership role in the attack and his extensive criminal history, which includes seven registered cases. The Bench highlighted the severity of the incident, especially in light of the ongoing threats against Justice Patel and his family, and noted that such situations warrant serious attention.

Ultimately, the Supreme Court denied Singh’s bail but granted him the option to submit a new bail application to the trial court, considering the time he has already spent in custody.
