Supreme Court Inquires State’s Stand on Bail Petition in Zubeen Garg’s Case

The Supreme Court of India has called for a response from the State regarding a bail application submitted by Shyamkanu Mahanta, an organizer of the Northeast Festival, implicated in the tragic drowning of renowned Assamese singer Zubeen Garg. The incident took place while Garg was swimming in the waters of Singapore on September 19, 2025. Mahanta maintains his innocence, asserting he was vacationing with family and friends on a yacht at the time of the tragedy.

Held in custody for almost nine months, Mahanta’s plea was considered by a bench comprising Justice BV Nagarathna and Justice Joymalya Bagchi. The court has issued a notice on the plea and scheduled a hearing for late July 2026, subsequent to the State acknowledging the notice.

Flight Risk Concerns Addressed

During the proceedings, the justices inquired about the possibility of Mahanta being a flight risk if bail were granted. Representing Mahanta, Senior Advocate Siddharth Dave assured the court that his client posed no such risk, having already surrendered his passport.

The case originates from the mysterious circumstances surrounding Zubeen Garg’s drowning, which led to several first information reports (FIRs) alleging criminal conspiracy and culpable homicide not amounting to murder against Mahanta and others. In response, Mahanta has petitioned the Supreme Court for the investigation to be transferred to an independent agency and for the consolidation of the numerous FIRs filed against him, which he claims exceed fifty in number.

He contends that the investigations have been prejudiced by public statements from authorities, media coverage, and threats, causing undue harm to his reputation. Despite the Singaporean authorities concluding the death was accidental with no signs of foul play, subsequent inquiries in India spurred legal actions and detentions.

Mahanta’s legal team argues that the case has been manipulated across various states, resulting in coordinated legal challenges. The plea also highlights the need for a fair and unbiased investigation into the incident.

The Supreme Court’s involvement comes amid widespread attention and debate surrounding the case, reflecting the significant public interest in the mysterious circumstances of Garg’s death. Mahanta’s ongoing custody and the legal intricacies involved continue to capture the focus of both legal professionals and the public.
