The Delhi High Court, in a recent ruling, chose not to entertain a Public Interest Litigation (PIL) that sought to compel the government to implement policies for job-oriented courses in educational institutions. The Division Bench, comprised of Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia, stated that such matters fall within the realm of policy decisions, which are not subject to direction under the Court’s writ jurisdiction as per Article 226 of the Constitution.
While the Court refrained from commenting directly on the petition’s prayer, it acknowledged the existence of current educational policies that encompass vocational training opportunities in both governmental and private sectors. “The policy relating to education which is in vogue currently does have various provisions where vocational training both in government and private sectors is available,” the Bench noted.
The petitioner, Sunil Kumar Sharma, was advised by the Court to present his case to the appropriate government authorities. The Bench remarked, “The entire writ petition, as a matter of fact, appears to be in the form of certain suggestions and accordingly adjudication of the prayers made in the petition is not possible by the Court.”
Furthermore, the Bench encouraged the government to address Sharma’s concerns and to make a decision that should be communicated to him. This decision underscores the Court’s stance on maintaining the separation between judicial functions and policy-making, reiterating the importance of directing such matters to the legislative and executive branches of government.
