Kerala High Court Dismisses Challenge to KC Venugopal's 2024 Election Victory

In a significant legal development, the Kerala High Court has rejected a petition contesting the 2024 electoral victory of Congress MP KC Venugopal from the Alappuzha constituency. The case, titled AM Ariff v KC Venugopal & ors, was adjudicated by Justice G Girish, who dismissed the petition under Order VII Rule 11 of the Code of Civil Procedure, 1908 (CPC).

The petition was initially brought forward by AM Ariff, a former Member of Parliament and a leader of the Communist Party of India (Marxist) [CPI(M)]. Ariff alleged that Venugopal’s victory in the 2024 Lok Sabha elections was tainted by corrupt practices during the campaign period. However, the court found these allegations insufficient to proceed with the case.

Justice Girish’s decision to dismiss the petition was based on Order VII Rule 11 of the CPC, which allows courts to summarily reject a plaint or petition without delving into its merits if it fails to disclose a cause of action, is undervalued, lacks sufficient court fee, or appears to be barred by law.

The dismissal followed the recusal of Justice A Badharudeen from the case in May, which subsequently led to Justice Girish taking over the proceedings. The court’s decision effectively ends Ariff’s challenge against Venugopal, who had secured a decisive victory in the elections by a margin of 63,513 votes over the Left Democratic Front (LDF) candidate, Ariff.

Legal representation for the petitioner, AM Ariff, was provided by Advocate J Om Prakash. On the other side, KC Venugopal was represented by an experienced legal team comprising Senior Counsel S Sreekumar and advocates Thomas P Kuruvilla, R Githesh, Harikrishnan S, Ajay Ben Jose, Manjunath Menon, Sachin Jacob Ambat, Anna Linda Eden, Hani P Nair, Naveen A Varkey, and Cyriac Tom.

This ruling underscores the stringent requirements for election petitions in India and highlights the judiciary’s role in ensuring the integrity of the electoral process.
